A group of KIIT Law School (KLS) students met Honorable Mr. Justice Kurian Joseph, Former Judge of the Supreme Court of India, in New Delhi on July 9, 2023, to gain insights into constitutional law. The students belonged to the KIIT Centre for Constitutional Studies and Research under KLS.
The discussion focused on various approaches to constitutional interpretation, including textualism, originalism, and living constitutionalism. Justice Joseph emphasized the importance of balancing the need for stability and adaptability in interpreting the Indian Constitution. He elaborated on his experiences in dealing with cases that required an active interpretation of the constitution to protect citizens’ rights, while also acknowledging the need for judicial self-restraint to respect the separation of powers.
